Defendants/appellants Provident Indemnity Life Insurance Company and its parent company, Provident American Corporation (herein collectively referred to as “Provident”), appeal the denial of the company’s motion to dismiss a RICO 1 claim filed by plaintiffs/ cross-appellants Doris E. James and Elmer W. James (the “James family”). The James family filed a cross-appeal which challenges the trial court’s determination that it lacked subject matter jurisdiction over their tort claims against Provident and the court’s dismissal of such claims.
