Orders unanimously modified in accordance with memorandum, and, as modified, affirmed, without costs. Memorandum: Following plaintiff’s injury on July 29, 1968 in a work-related accident which occurred during the course of his employment for Niagara Window Cleaning Corporation, the State Insurance Fund, lienor, paid plaintiff $13,083.66 in workmen’s compensation benefits. Thereafter, plaintiff commenced a negligence action against defendants, the lessee and owner of the building on which he was working when injured.
