Error from the supreme court. In the great fire which occurred in the city of New-York, in December, 1835, buildings occupied by the plaintiffs in the above entitled causes 'as lessees were blown up by order of the mayor of the city, to prevent the spreading of the conflagration. The buildings contained merchandise to a large amount, but a portion of it did not belong to the lessees : some part of it being held by them as factors or agents of other persons, and another part merely on storage. In the case of The Mayor, &c., of New-York v. R. L. & D. N. Lord, 18 Wendell 126, this court permitted D. N. Lord, who held an unexpired term of about five months in the building which was destroyed by fire, under the eighty-first section of the act to reduce the laws relating to the city of New-York into one act, to recover for the value of his goods in the store destroyed, on the ground that he was interested in the building.
