This is an appeal from a judgment for defendant-appellee entered after trial of the issues before Judge Bailey Brown in the United States District Court for the Western District of Tennessee.

Plaintiff-appellant, J. Wiss and Sons Co., is an old established scissors, shears and garden tool manufacturer. Defendant-appellee, Gee Whiz Tool Corporation, is a newer entrant into at least some of the same lines of manufacture.
