delivered the opinion of the court.

It appears from the record in this case that Dora Lucy Gfaddis and Wilford Gaddis, who are husband and wife, are living separate and apart from each other, and have been so separated since November, 1922; that they have a daughter who was born on October 1,1920, and is at this time between five and six years of age. Since the separation of the husband and wife, she has been living with her father in his home in the city of Mattoon, and Gaddis has continued to reside in the home of his father on a farm in Moultrie county.
