Banke, Judge.

The appellant was convicted of burglary based upon evidence obtained after the vehicle in which he was riding was stopped by an officer of the Douglas County Sheriffs office. The principal issue on appeal concerns the constitutionality of the “stop” of the vehicle and the ensuing seizure of evidence from it.

The facts show that an officer of the county sheriffs department was returning to the police station from his home on the afternoon of February 12,1979, when he noticed a Chevrolet Vega, with a Fulton County tag, occupied by three men. His attention was drawn to the vehicle…
