Appeal by the plaintiff, Jesse Oarll, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Suffolk on the 17th day of October, 1896, upon the dismissal of the complaint upon the merits directed by the court after a trial before the court and a jury at a Trial Term of the Supreme Court held in and for the county of Suffolk.

The plaintiff sought by this action to recover damages on account of the collection and discharge of surface water upon his land in-larger quantity than naturally flowed thereon, and which carried with it large quantities of dirt, stone and other material, cutting deep gullies in the land, and rendering the same unfit for the prosecution of his business thereon as formerly carried on by him.
