KRUEGER, Judge.

The offense is burglary. The punishment assessed is confinement in the state penitentiary for a term of five years.

Appellant’s only complaint relates to the court’s action in *378declining to peremptorily instruct the jury to return a verdict of not guilty on the ground that the evidence was insufficient to sustain his conviction.
