Appeal from a judgment of the circuit court for Milwaukee county: I). IT. JohNSON, Circuit Judge. Prior to 1871 one James Jenkins was tbe bolder of the legal title to a tract of about 17,000 acres of timber lands. He held in bis own right a three-fourths interest, and the legal title of the remainder as a security for the payment of a loan of $10,000 to Elijah Swift, who was the real owner thereof.

The determination of this case has' been greatly delayed. , If any explanation is necessary it may be found in the fact of the inability of the members of the court earlier to meet on any common ground. From the outset, however, the court has been unanimous in the opinion that the judgment of the court below could not stand.
