GREENBERG, Circuit Judge.
This matter comes on before this court on an appeal from an order of the district court entered October 22, 2001, granting summary judgment in favor of Allstate Insurance Company in this insurance policy bad faith action predicated on Allstate’s failure to settle a claim asserted by appellant Dennis Haugh against its insured, Theodore Uher. The district court held that the statute of limitations barred Haugh’s statutory bad faith claim against Allstate and rejected his argument that as Uher’s assignee he can assert a separate common law cause of…
