Appellee presented a claim to the board of supervisors of Marion county for balance due him. for compensation f.or services as sheriff, and for clerk hire, stationery, fuel, etc., to be paid by the county out of certain fees earned by him in criminal eases, where the defendant was acquitted or otherwise legally discharged without the payment of costs. The board of supervisors disallowed his claim, and he appealed from their decision to the circuit court of that county, and that court rendered judgment thereupon in his favor.
