LAWSON, Justice.
On the morning of January 23, 1943, the appellee, T. K. Lee, a Mr. Bales, and Charles A. Nelson left Birmingham in a car owned and driven by Mr. Bales, for the purpose of shooting hawks and crows. Lee and Nelson both carried high-powered rifles. They travelled as far south as Brent, Alabama, and returned to Birmingham late in the afternoon by way of the Montgomery highway. Throughout the trip Lee sat in the front seat on the driver’s right. Nelson was sitting on the rear seat.
