*1351Appeal from a judgment of the Supreme Court, Erie County (H. William Boiler, A.J.), rendered June 29, 2006. The judgment convicted defendant, upon a jury verdict, of robbery in the third degree and resisting arrest.

It is hereby ordered that the judgment so appealed from is unanimously affirmed.
