Appeal from an order of the Supreme Court, Niagara County (Richard C. Kloch, Sr., A.J.), entered December 14, 2009. The order granted the motion of defendants for summary judgment, *1526dismissed the complaint and vacated and cancelled the notice of pendency filed by plaintiffs.
It is hereby ordered that the order so appealed from is unanimously affirmed without costs.
