hOn January 23, 2002, a petition, erroneously captioned as a “Petition for Damages,” was filed on behalf of American Medical Enterprises, Inc. (“American Medical”)1 in the 19th Judicial District Court in and for the Parish of East Baton Rouge, State of Louisiana. The sole defendant named therein was Audubon Insurance Company (“Audubon”).
