This is an appeal from an order of the Circuit Court of Adams County, overruling the motion of Otis Carter, appellant, for leave to withdraw his plea of guilty and to substitute a plea of not guilty. He was charged with assault and battery with intent to kill.

The November term of circuit court was for six weeks. Carter was indicted on November 8, 1962. The next day he entered a plea of not guilty. Trial was set for November 15. On that day he appeared before the court, with counsel, and asked leave to withdraw his plea of not guilty and substitute a plea of guilty. This request was granted.…
