In a family offense proceeding pursuant to Family Court Act article 8, the wife appeals from an order of the Family Court, Queens County (O’Connor, J.), dated May 29, 2009, which granted the *1209husband’s motion to dismiss the petition for her failure to establish a prima facie case.
Ordered that the order is reversed, on the law, without costs or disbursements, the petition is reinstated, and the matter is remitted to the Family Court, Queens County, for further proceedings in accordance herewith.
