DECISION AND ORDER GRANTING DEFENDANT’S MOTION TO DISMISS

The plaintiff, Federal Deposit Insurance Corporation (FDIC), which is acting as receiver for the National Bank of Washington (NBW), has sued the debtor Calhoun as defendant in this adversary proceeding for a determination that its claim against him is non-dischargeable under 11 U.S.C. § 523(a)(2)(A) or (B).
