This matter is before the Court on the limited issue of whether non-prospective social security disability payments are properly subject to consideration by a court in making an equitable distribution award. Pursuant to the Court’s earlier partial ruling on equitable distribution, all other property issues have been adjudicated. Complainant Florence J. Holland (“Wife”) contends that funds presently and previously on deposit in an account at Wachovia Bank (“the Wachovia Account”) now titled solely in Husband’s name, are marital property and therefore can be considered…
