The appellee, Mrs. Mary Busic Lee, brought suit against the railroad company for the death of her husband, Dr. Lee, who was killed on the 23d day of November, 1926, by a train of the appellant, while the deceased, Dr. Lee, was walking along the track of the railroad company with his back to an approaching train.
