Before the court is defendant Amoco Oil Company’s (“Amoco”) motion to dismiss filed on October 31, 1996 pursuant to Fed. R. Civ. Pro. 12(b)(6). In this action, plaintiff, Ergon, Inc., (“Ergon”) seeks to recover from defendant the costs of cleaning up contamination caused by defendant’s alleged spilling of gasoline products.
