Ray D. Luzadder brought an action in replevin against C. E. Hale and wife and the Hill-Howard Motor Company for the possession of a Yelie automobile in which the plaintiff claimed a special ownership by reason of a chattel mortgage on the automobile executed by C. E. Hale and wife. The petition alleged that *86Hale was the owner and in possession of the automobile at the time the mortgage was given, and other usual allegations in such an action.
