Appeal by the defendant, Josephine Kran dusky, from a judgment of the Supreme Court in favor of the plaintiff, ,entered in the office of the clerk of the county of Cattaraugus on the 15th day of September, 1906, upon the verdict of a jury, and also from an order entered in said clerk’s office, on the 31st day of December, 1906, denying the defendant’s motion for a new trial made upon the minutes. ■

Spring, J.:

On the 1st day of November, 1904, the defendant was the owner of a farm situate in the town of Allegany, Cattaraugus county. On that day, by an instrument commonly known- as an oil lease, she leased to the plaintiff, in consideration of the sum. of $100, which was on that day paid to her, the right to operate and drill for petroleum and gas upon said premises “ for and during the term of five years from the date hereof, arid so long thereafter as oil or gas can be produced in paying quantities.” By the' terms of the contract the defendant was to receive one-eighth part of all the…
