This action is brought by the plaintiff to recover for injuries alleged to have been suffered by her as a result of a *322fall which she claims was due to the defective condition of a sidewalk in the town of Hempstead. She has brought her action against the town and also against the owner of the property abutting upon the sidewalk alleged to have been defective.
