I. INTRODUCTION

This cause is before the court on a Motion to Dismiss filed by Defendants the City of Montgomery (“the City”), Montgomery police detective Kevin Murphy (“Murphy”) and fictitious defendants A through G (“the fictitious defendants”) (collectively, “Defendants”) on July 15, 1998.
