Plaintiff is a non-profit association composed of people whose interest is to beautify, preserve and maintain Opal Lake and its environs in Otsego County. All but two of the association’s 59 members own riparian land on Opal Lake. The lake itself is a relatively small one of approximately 120 acres of surface water and between 2-1/2 to 3 miles of shoreline. It is relatively clean and placid, presently has approximately 70 dwellings ringing its shores, a public access site with 200-240 feet of shore frontage, and as yet has no commercial activities on its shoreline.
