It appeared from the evidence that they were living in a state of separation at the time of the homicide. The body of the deceased was found on the floor of her residence in the city of Macon, the head and shoulders being in her room and the other part of her body extending into the front hall near the front door. 8. When the girl left the accused on Saturday night at the drugstore, she -returned to the church and the accused went to the house of the deceased. When the girl returned home immediately after church service she discovered the body of her mother lying as indicated in the statement of facts. The deputy sheriff and the jailer of the county, about two o’clock Sunday night following, found and arrested the accused at the M. & A. junction on the Central Eailroad, a little more than four miles from the city.
