In a habeas corpus proceeding, the petitioner appeals from a judgment of the Supreme Court, Dutchess County (Braatz, J.), dated September 30, 1985, which dismissed the proceeding.

Ordered that the appeal is dismissed as academic, without costs or disbursements.
