The plaintiff in error, hereinafter called the defendant, was convicted on a charge of possession of corn whisky with the unlawful and willful intent on the part of the said Hubert Hamner to barter, sell, give away, and otherwise dispose by the same in violation of the prohibitory laws of the state, and was sentenced to pay a fine of $500 and be imprisoned in the county jail for 180 days. The record was properly preserved, and defendant has appealed to this court.
