Appeal from Woodbury District Court. — Hon. J. W. Anderson, Judge. Suit in equity to enjoin defendants from interfering with or preventing plaintiff from building a fence, or fences, upon certain lands claimed to belong to him and from tearing down the fences erected by him upon the E % of the NE]4 of Section 9, Township 88, Range 46 West of the 5th P. M. The defendants answered, and, upon the issues tendered; the trial court dismissed the petition, and plaintiff appeals.
