This appeal by Mr. Ellis, a private citizen, against the City of West University Place, an incorporated city, town, or village, under Title 28, Revised Statutes of Texas, Vernon’s Ann.Civ.St. Art. 961 et seq., is from a “take nothing” judgment entered by the 61st District Court in his suit against the City, through which he sought damages for its having procured the is*179suance against him of a restraining-order, a temporary injunction, and a supersedeas writ, in former litigation between the parties, wherein the City claimed he had violated its zoning ordinance by erecting a…
