Plaintiffs bring this action under 42 U.S.C. § 1983 seeking injunctive and declaratory relief. Plaintiffs contend that Defendants have violated the First, Fifth, and Fourteenth Amendments of the United States Constitution and Article I, Sections 2 and 3 of the Rhode Island Constitution by preferentially allocating permits for the use of publicly owned and maintained athletic fields to private religious schools.
