Appellant, Stephen A. Martin, was charged by indictment with two counts of armed criminal action and one count of assault in the second degree. In a separate indictment, appellant was charged with first degree murder. The State of Missouri waived the death penalty and the charges in both indictments were consolidated upon the State’s motion. After a jury trial, which began June 12, 1989, and lasted until June 16, 1989, appellant was found guilty of murder in the second degree, second degree assault and two counts of armed criminal action.
