BliANNON, PRESIDENT :

H. PI. Weir was sentenced to a ten years term, in the penitentiary from Pocahontas county for selling cocaine, and brings this writ of error.

Count- 2 of the indictment, on which he was tried, charged that he ‘‘Did feloniously and unlawfully, sell, give away and dispense cocaine and mixtures containing cocaine, the said EL. H. Weir not being then and there a licensed manufacturing pharmacist or chemist or wholesale or retail druggist; and the said H. II. Weir not being then and there in charge of any hospital, college, scientific or other public institution; and the said…
