On June 16, 1906, the ITorner-Gaylord Company, a corporation, and others, creditors, filed their petition in involuntary bankruptcy against George Miller and Charles *296Bennett, partners trading as Miller & Bennett and also as George Miller & Co., and on the same day the}'- presented to this court their bill against said parties, Porter Bennett, Samuel Bennett, Scott Bennett, William V.
