Action by appellee against appellant to recover damages for the alleged wrongful death of his minor daughter who lost her life as the result of an accident which occurred within the corporate limits of appellant city, May 21, 1921, and on a road which had previously been improved by the county, under the pro visions of §§7711a et seq. Burns 1914. This improved road which was known as Liberty trail was partly within and partly without the corporate limits of the city.
