In this appeal, we consider issues that arose during the trial of an action for breach of a construction contract.

Stanley Construction Company, Inc. (Stanley Construction), filed its amended motion for judgment against Cardinal Development Company (Cardinal). Stanley Construction alleged that Cardinal breached its construction contract by refusing to pay Stanley Construction for certain additional work it had performed.
