This is an equitable action which was filed in the Fayette circuit court by appellees, William 0. McCommas and others, as plaintiffs, against appellant and defendant below, L. H. Brown, to compel him to specifically perform a written contract entered into between the parties on May 26, 1921, whereby plaintiffs agreed to sell and defendant agreed to purchase lot number 16 in Hay-land’s subdivision in Fayette county, Kentucky, containing about 11 acres.
