This is an action on a promissory note. The summons and complaint were dated February 18, 1926. The complaint sets forth, in the usual manner, a promissory note for $2,000, dated December 10, 1924, due October 2, 1925, signed by the defendant, S. E. Easterling, and indorsed by the defendants, E. W. Easterling and John D. Easterling, the payments, and the balance due thereon.

The defendants by their answer admit the execution of the note, but set up the following defense:
