MEMORANDUM OPINION

GASCH, District Judge.

On February 12, 1967, defendant was arrested for operating a motor vehicle without running lights and without a valid driver’s license. It became apparent at the precinct station house that defendant was unable to produce collateral and that his incarceration would be required. A routine pat-down search was made, and he was placed in the cell block.
