AMENDED MEMORANDUM-DECISION and ORDER
HURD, United States Magistrate Judge.
I. Introduction.
On January 28, 1983, the plaintiff, Olivia Slade, sustained catastrophic injuries in an automobile accident which occurred in the Town of Sandgate, Vermont. On that date, she was three years old, and was a passenger in a 1976 Jeep CJ-7 being operated by her mother, Hope Slade. The vehicle went off the side of the road, over a culvert, and came to rest in a ditch.
