On May 19,1900, John Johnson was struck and killed by an engine drawing a freight train on the crossing of the Chicago, Burlington & Quincy Railroad over Ben street in the city of Plano. His administratrix brought this action against the railroad company to recover for the loss to his next of kin, charging the death was caused by the negligence and misconduct of the servants of the railroad company running said train.
