The defendant, Terry Vince, was charged by grand jury indictment with one count of first degree murder, a violation of La. R.S. 14:30, and he pled not guilty. He moved to suppress a taped telephone conversation between himself and his cousin, but the motion was denied. Following the guilt phase of a jury trial, he was found guilty as charged by unanimous verdict. However, the jury deadlocked during the penalty phase of the trial.
