The plaintiff in this case recovered a judgment against Theodore and Charles F. Van Brunt and Charles S. Watrous, on the 11th February, 1860, for $>4563.02 damages and costs, for hogs sold them prior to the 14th day of December, 1859. On that day the judgment debtors executed an assignment in trust for the benefit of creditors; or rather, it was executed by two of them on that day, and by the other on the 16th day of December.
