—Order modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Defendant, the Board of Education for the City School District of the City of Buffalo (Board), appeals from an order of Supreme Court that denied its cross motion to dismiss the complaint. The individual plaintiffs are 186 former teachers for the City of Buffalo School District who formed an informal alliance for the purpose of this litigation.
