Appeal from Circuit Court, Monongalia County. Suit by John S. Google against Nancy Smith and others. From a decree dismissing the bill for failure to diligently prosecute, plaintiff appeals.

The bill filed in this cause at June rules, 1910, and dismissed by the court December 14, 1918, for failure to prosecute with diligence, had for its only object partition between plaintiff and defendant of a tract of about 3'0 acres of land in Monongalia County. Besides proceedings at rules, there were entered in the cause eight different court orders which are briefly noted and designated by number and dates of entry.
