Plaintiff, as administrator of the estate of IV. S. Kenneth, brought this action against the Miller Hotel Company, to recover damages sustained by the widow and next of kin by reason of the death of his decedent, which plaintiff alleged was caused by the defendant’s negligence. A trial in the district court for Douglas county resulted in a verdict for the defendant. A motion for a new trial was overruled, judgment was rendered on the verdict, and the plaintiff has appealed.
