MEMORANDUM OPINION

KAPLAN, District Judge.

This dispute over the composition of an arbitration tribunal calls upon the Court to determine whether Allan H. “Bud” Selig is, or in law must be treated as, the Commissioner of Baseball.

The dispute.arises in consequence of provisions of the agreements governing professional baseball which permit major league teams to take, or “draft,” the territories of minor league teams for the purpose of locating in the areas occupied by minor league teams.
