The complainant owns a secret process for making a medicinal product known as “Paine’s Celery Compound,” or “Celery Compound,” for many years, extensively sold under a registered trade-mark showing a head of celery. The article is placed in bottles bearing the word “Paine’s” on one side, and the words “Celery Compound” on the opposite side, while on the cork is a label showing the trade-mark and carrying the words “Paine’s Celery Compound.” On a third side of the bottle is a label showing a larger picture of the trade-mark, whereon is printed in large letters, “Celery…
