On May, 7, 1917, the appellant herein, Cyrus E. Hodde, as receiver of the Henseler Mercantile Oil & Supply Company, a corporation, recovered a judgment against William Grafeman in the circuit court of the city of St. Louis. In due course Grafeman per-, fected his appeal from said judgment to this court, giving a supersedeas bond duly approved hy the circuit court. During the pendency of the appeal Grafeman died, and letters of administration were issued on Ms estate by the probate court of the city of St. Louis.
